## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the diagnosis, the years of firefighting service and the date of diagnosis, using a firm-controlled tool, table the opened cancer list, the qualifying period and who the page says is covered. Do not decide that the presumption applies. |
| What the lawyer must review | Decide whether this cancer and this service meet the presumption that page states. Do not mix one state's cancer list or qualifying period with another's. Where the page does not state a rule, leave it open and confirm the Act. Health and wage records stay in a firm-controlled tool. Apply ASCR r 9, APP 11, and the notifiable-breach test. |

## Checking plan

**Source-by-source verification**

The lawyer checks the output against the file and the linked sources before it is used or sent.

- What the AI does: From the diagnosis, the years of firefighting service and the date of diagnosis, using a firm-controlled tool, table the opened cancer list, the qualifying period and who the page says is covered. Do not decide that the presumption applies.
- What the lawyer does: Decide whether this cancer and this service meet the presumption that page states. Do not mix one state's cancer list or qualifying period with another's. Where the page does not state a rule, leave it open and confirm the Act. Health and wage records stay in a firm-controlled tool. Apply ASCR r 9, APP 11, and the notifiable-breach test.
- Who reviews: Lawyer competent in statutory workers compensation
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.
- Why: The level reflects what the work is, the consequence of an error, and how much the lawyer must check on every file.

## Checks the lawyer makes

1. Use only the list and the period on that state's opened page. Oesophageal cancer is 25 years on the Victorian and New South Wales pages and 15 years on the Queensland fire page.
2. Check the diagnosis date against the date the page states: 1 June 2016 in Victoria, and 27 September 2018 in New South Wales. The Queensland fire page states no equivalent date.
3. Do not fill a gap in who is covered. The Queensland page does not state that class. The New South Wales retrospective circumstances are not listed.
4. If the presumption is not met, say so and leave the ordinary disease test to its own task.

## Notes

- The 2023 comparison table lists 12 Queensland cancers. The fire department page opened the same day says 23 after August 2024. The Act sections cited by the table were not opened.
- A Country Fire Authority volunteer scheme is mentioned by WorkSafe and was not opened.
- If health or wage records leave the firm-controlled tool, decide whether a Privacy Act 1988 (Cth) breach is notifiable.
