## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the dates the lawyer supplies, draft an internal diary for the Victorian time limits the lawyer has selected. The tool does not send correspondence or decide that a late step is still available. |
| What the lawyer must review | Confirm which limit applies: TAC section 68, a 60-day conciliation, or a 30-day approval summons. A child, a late manifestation or a dust-related condition can change the date. Check that before the diary is used. Keep medical and wage records in a firm-controlled tool. Apply ASCR r 9 and APP 11. |

## Checking plan

**Verify against sources**

The lawyer selects the Victorian time limit and checks the diary against the file before anyone relies on it.

- What the AI does: From the dates the lawyer supplies, draft an internal diary for the Victorian time limits the lawyer has selected. The tool does not send correspondence or decide that a late step is still available.
- What the lawyer does: Choose the applicable limit, check the dates, and approve any letter before it is sent.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. For a Part 3 transport-accident claim, diary one year after the accident, death, or first manifestation under section 68(1). Under section 68(2) the Commission may accept a later claim if it considers there are reasonable grounds for the delay, and only before three years. Under section 68(3) a person who was under 18, and for whom no claim was made, may claim before age 21 or within 3 years after the accident, whichever is later.
2. For a WorkSafe agent or self-insurer decision, diary 60 days for a Workplace Injury Commission conciliation, and record that a late application needs a reason.
3. For a Supreme Court compromise by a person under disability, diary 30 days for the rule 15.08 summons.
4. Do not put health information into a public tool. SC Gen 25 says confidential or sensitive information should not be entered into a public AI tool.

## Notes

- Letters that go to a client or another party are checked on each matter. This diary is an internal working list.
- The Transport Accident Act in force on 23 October 2026 is authorised version 158, effective 2 October 2026. Section 68 was read in that version.
- Keep health, wage and scheme records in a firm-controlled tool. Apply ASCR r 9 and APP 11, and consider whether any breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victorian plaintiff personal injury file: Transport Accident Commission, Workplace Injury Commission, or the Supreme Court

**Deliverable**: An internal diary of the selected Victorian time limits, with the source of each date.

**Inputs**

- Accident, injury-manifestation, decision or compromise date supplied by the lawyer
- Whether the person was under 18 at the accident
- The current section or page for the step being diarised

**Example**: Illustrative example: The accident was 14 months ago and no injury was apparent that day. The diary shows the section 68(1)(d) year from manifestation and the section 68(2) three-year acceptance. The lawyer decides whether to ask the Commission to accept a late claim.

**Stop and escalate when**

- The diary states that a late claim, conciliation or summons is still available.
- The date depends on a fact the lawyer has not supplied.

Checked 2026-10-23.
