| What the lawyer must review | Check every letter before it is sent to the client, insurer or respondent Confirm the diary uses the Act for this claim, not a generic personal injury timer Keep medical and wage records out of a public tool A document filed at court still needs a named responsible practitioner |

## Checking plan

**Verify against sources**

The lawyer checks each outgoing letter and each diarised date against the Act that applies to the claim.

- What the AI does: From the dates and scheme the lawyer enters, diary the notice and limitation dates and draft routine letters from the firm's templates. Do not send anything.
- What the lawyer does: The lawyer confirms the scheme, checks each letter, and decides what is sent.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. For a public liability claim, diary part 1 of the notice under the Personal Injuries Proceedings Act 2002, section 9(3): on the earlier of two days. The first is the day 9 months after the incident or, if symptoms of the injury were not immediately apparent, the first appearance of symptoms. The second is the day 1 month after the claimant first instructs a law practice to act in seeking damages and the proposed defendant is identified.
2. For a motor accident damages claim, diary Motor Accident Insurance Act 1994, section 37. An unidentified vehicle has a 3 month notice to the Nominal Defendant and a 9 month bar.
3. For a damages action covered by the Limitation of Actions Act 1974, section 11, diary 3 years from when the cause of action arose. Dust-related conditions are not subject to that limit.
4. Do not put client medical or wage information into a public chatbot. Queensland Courts say that information can become public.

## Notes

- Letters a client or another party receives are checked on each matter. A diary entry that nobody receives is not a substitute for that check.
- Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025 apply when the output is a submission, not when it is an internal diary entry.
- Medical and wage records stay in a firm-controlled tool. Apply ASCR r 9 and APP 11, and consider whether a breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland plaintiff personal injury file: public liability, motor accident or workers' compensation, as the lawyer identifies it

**Deliverable**: A checked diary and draft letters still held for the lawyer to send.

**Inputs**

- Incident date, symptom date and the date a lawyer was first instructed
- The scheme the lawyer names
- The firm's letter templates

**Example**: Illustrative example: The draft diaries one month from first instructions on a motor accident. The lawyer changes it because section 37 uses the earlier of that month and 9 months, and asks whether the vehicle is unidentified.

**Stop and escalate when**

- The scheme is not identified, so the notice period cannot be chosen.
- The draft would send medical information outside the firm.

Checked 2026-10-23.
