## Checking plan

**Verify against sources**

Routine letters are drafted for the lawyer to read before sending. A letter the client or another party receives is checked on every occasion.

- What the AI does: Draft routine letters and diary entries from the lawyer's instructions and the dates already on the file. Do not send anything, and do not place health or compelled records in a public tool.
- What the lawyer does: Read and approve every outgoing letter, and decide whether a court or Commission rule applies to it.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Do not send a letter that states liability, quantum or a time limit the lawyer has not checked.
2. If the letter will be lodged or used in the Commission, apply PIC13 paragraphs 10 to 12.
3. If the matter is in the Supreme Court, the District Court or the Local Court, apply Practice Note SC Gen 23. The District Court and the Local Court adopt it.
4. Confirm the tool keeps confidential material inside a controlled environment that does not train a model.

## Notes

- Practice Note SC Gen 23 commenced on 3 February 2025. The Local Court practice note adopting it commenced on 12 January 2026.
- A letter the client or another party receives is checked every time. It is not a template that can be approved once at setup.
- Health and wage records stay in a firm-controlled tool. The lawyer applies ASCR r 9 and APP 11, and decides whether any breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: A New South Wales plaintiff personal injury file, including matters that may go to a court or the Personal Injury Commission

**Deliverable**: A draft letter or diary note for the lawyer to approve before it is sent or relied on.

**Inputs**

- The lawyer's instructions for the letter
- Dates and documents already on the file
- Whether the letter will go to a court or the Commission

**Example**: Illustrative example: The draft chases wage records and a certificate of capacity. The lawyer removes a sentence that reads as a concession about capacity before the letter is sent to the insurer.

**Stop and escalate when**

- The letter states a legal conclusion the lawyer has not made.
- Health or compelled records would be placed in a public tool.

Checked 2026-10-23.
