## Checking plan

**Verify against sources**

The lawyer decides inspection. The tool flags third-party and sensitive pages.

- What the AI does: From the produced records, build a page index marking the date, the author and any page naming a person other than the client. The tool does not decide what may be inspected.
- What the lawyer does: Decide which pages may be inspected or copied. The tool only indexes and flags.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Practice Note SC CL 3 paragraph 6.3, after pleadings close, is about discovery categories and redaction of documents to be discovered. Do not apply it to pages produced on subpoena.
2. Open the flagged page. Do not rely on the index alone.
3. Hold a page that names another patient until the lawyer decides the claim of confidence.
4. Do not enter the records in a public AI tool. Practice Note SC GEN 25 and County Court note PNCCV 1-2026 both say so.

## Notes

- Practice Note SC GEN 25, issued on 14 May 2026, covers Supreme Court documents, including pleadings, submissions and expert reports. Do not put confidential or sensitive material into a public AI tool.
- County Court practice note PNCCV 1-2026, issued on 5 June 2026, is to the same effect and cites Form 44A of the County Court Civil Procedure Rules 2018.

## Practical guide

Jurisdiction: Production under a subpoena in a Victorian personal injury proceeding

**Deliverable**: A page index with third-party and sensitive pages flagged.

**Inputs**

- The produced clinical records
- The lawyer's list of the client's treating practitioners
- Any agreed redaction categories

**Example**: Illustrative example: A hospital bundle includes another patient's name on three pages. The index flags those pages. The lawyer decides whether they are inspected.

**Stop and escalate when**

- The produced set cannot be opened page by page.
- The tool is asked to decide that a page may be copied to another party.

Checked 2026-10-23.
