## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the decision, the transcript and the exhibit list the lawyer names, using a firm-controlled tool, index the record and list candidate points only as headings. Write nothing in the notice of appeal or the grounds. |
| What the lawyer must review | You decide whether to appeal, and you write the notice and the grounds. Verify every citation yourself. Where the Commission is the appeal body, file Form 9 within 20 business days of receiving the review decision. Do not choose between Form 5 and form 2A. Use the form shown on the day of filing. Use a firm-controlled tool. Do not use a generative tool to check that a citation exists. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The tool indexes the record. The lawyer writes the notice and the grounds.

- What the AI does: From the decision, the transcript and the exhibit list the lawyer names, using a firm-controlled tool, index the record and list candidate points only as headings. Write nothing in the notice of appeal or the grounds.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Index only documents the lawyer names.
2. Keep a Commission appeal separate from an Industrial Court appeal.
3. Write nothing in the notice or the grounds.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- The WorkSafe guide says a Commission appeal uses Form 9, filed within 20 business days of receiving the review decision, where the Commission is the appeal body. A copy goes to Workers' Compensation Regulatory Services within 10 business days of filing. The appellant must prove the case on the balance of probabilities and call witnesses, including the appellant. The Commission's page agrees on Form 9 and the 20 business days. It says an Industrial Court appeal is within 21 days and is started by Form 5, generally on an error of law or an excess or want of jurisdiction. The WorkSafe guide names form 2A for that Court. The form is the one the Commission's forms page shows on the day. No filing fee is charged for the appeal. Costs generally follow the event and are described as costs of the hearing.
- The Commission's page says section 548A(2) makes an Industrial Magistrate the appeal body for a Regulator decision under section 107E, a Regulator decision under section 540(1)(a)(i) to (vi), or a non-reviewable decision, and that Form 67 is filed in the Magistrates Court. The text of section 548A was not opened. No generative-AI practice direction of the Commission or the Industrial Court was opened.

## Practical guide

Jurisdiction: Appeal from a Queensland workers' compensation review decision

**Deliverable**: An index of the record and heading-only points. No notice and no grounds.

**Inputs**

- The review decision
- The date it was received
- The transcript and exhibits the lawyer names
- Whether the Commission or an Industrial Magistrate is the appeal body

**Example**: Illustrative example: The review decision was received on 1 July 2026 and the Commission is the appeal body. The index lists the decision and the exhibits the lawyer named. The notice and the grounds are blank, and the note records Form 9 and 20 business days.

**Stop and escalate when**

- The tool is asked to write the notice or the grounds.
- The appeal body is not identified, so the form cannot be named.

Checked 2026-10-23.
