## Checking plan

**Verify against sources**

The timetable is the service list in the practice directions. The lawyer decides the hearing date and what is served.

- What the AI does: From the hearing date the lawyer gives, list who is served and the five business days in Practice Direction 15 of 2018. Do not write the opinion or the solicitor's material, and do not serve anyone.
- What the lawyer does: The lawyer sets the hearing, decides who is served, and settles anything that is filed.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Supreme Court Practice Direction 15 of 2018: the application and supporting material, other than the opinion, are served on the Public Trustee five business days before the hearing, unless an authorised officer has agreed in writing to a shorter period. An existing administrator or guardian under the Guardianship and Administration Act 2000, and an attorney under the Powers of Attorney Act 1998 who is exercising power, are served the same way.
2. The opinion is not served on the defendant. The direction says the plaintiff should ordinarily provide an opinion of counsel. In some circumstances the opinion may be from a solicitor who is an accredited specialist in personal injuries, or an experienced personal-injuries solicitor. Unless there are exceptional circumstances, that solicitor is independent of the firm which took the instructions or prepared the matter.
3. The sample orders say the plaintiff's solicitors serve a copy of the order on the trustee within seven days. That is in the sample orders. District Court Practice Direction 6 of 2018 paragraph 2 says paragraphs 3 to 12 of the Supreme Court direction apply in that court, and its own sample orders also use seven days for service of the order.
4. The tool prepares the list of who is served and the dates. It does not write the opinion, it does not write the material rule 98 requires, and it does not serve anyone.

## Notes

- Rule 98(2) requires material from the solicitor and a statement by the litigation guardian. The tool writes nothing in either. Those documents are not served unless the court orders.
- No sanction form number was opened.

## Practical guide

Jurisdiction: Queensland Supreme Court or District Court sanction hearing

**Deliverable**: A service list and dates from the hearing date the lawyer gives. Nothing is written into the opinion and nothing is served.

**Inputs**

- The hearing date the lawyer gives
- Whether an administrator, guardian or attorney is to be served
- The court the lawyer names

**Example**: Illustrative example: The hearing is on a Tuesday. The list dates service on the Public Trustee five business days earlier and does not include the opinion in that service.

**Stop and escalate when**

- The draft writes the opinion or the reasons.
- The hearing date has not been given.
