| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the lawyer's witness list, record whether each necessary witness is available for the trial dates. The tool does not set a running order the rules do not provide. |
| What the lawyer must review | The lawyer decides who is a necessary witness and whether each is available. Treat availability as part of being ready for trial under rule 467. A consent order may address a joint expert or a conclave. Do not use it to set the order of witnesses. Do not set a witness running order from a Queensland direction. None that was opened does. |

## Checking plan

**Verify against sources**

The lawyer confirms availability under rule 467. The tool does not invent a running order.

- What the AI does: From the lawyer's witness list, record whether each necessary witness is available for the trial dates. The tool does not set a running order the rules do not provide.
- What the lawyer does: Decide who is necessary and confirm availability before the request is signed.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. A party is not ready for trial unless all of that party's necessary witnesses will be available.
2. The request for trial date is signed on that basis. Do not sign it while a necessary witness is unavailable.
3. Practice Direction 9 says a consent order should, as appropriate, address expert evidence, including a joint expert or a conclave report.
4. Do not prepare a witness-order document as if a practice direction required one. None was opened.

## Notes

- Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025 require a named practitioner to verify references in submissions. They are not a ban on generative AI in evidence.
- The Queensland Courts generative AI page says not to enter private, confidential, suppressed or privileged information into a public chatbot.

## Practical guide

Jurisdiction: A Queensland personal injury proceeding approaching a request for trial date

**Deliverable**: An availability note for the necessary witnesses. Not a court running sheet.

**Inputs**

- The lawyer's list of necessary witnesses
- The likely trial dates
- Any conclave direction

**Example**: Illustrative example: One treating doctor is overseas for the month of the trial. The note marks the party as not ready. The lawyer does not sign the request.

**Stop and escalate when**

- The lawyer has not said which witnesses are necessary.
- The tool is asked to file a running order.
