## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the professional service and the peer opinion the lawyer supplies, build a question table. The lawyer names the civil liability statute. Where that statute is the Civil Liability Act 2002 (NSW), the questions are s 5O. The tool does not decide whether the opinion is widely accepted or irrational, and it does not write the advice. |
| What the lawyer must review | The lawyer decides whether it is established that the professional acted in a manner that was widely accepted in Australia by peer professional opinion as competent professional practice at the time the service was provided, and whether the opinion is irrational, and writes any advice. Other jurisdictions are checked on their own Act. The NSW section is the one opened for this task. |

## Checking plan

**Lawyer decides the peer-opinion finding**

The tool rows the peer-opinion questions from material the lawyer supplies. The lawyer decides whether the opinion can be relied on and writes any advice.

- What the AI does: From the professional service and the peer opinion the lawyer supplies, build a question table. The lawyer names the civil liability statute. Where that statute is the Civil Liability Act 2002 (NSW), the questions are s 5O. The tool does not decide whether the opinion is widely accepted or irrational, and it does not write the advice.
- What the lawyer does: The lawyer decides whether it is established that the professional acted in a manner that was widely accepted in Australia by peer professional opinion as competent professional practice at the time the service was provided, and whether the opinion is irrational, and writes any advice. Other jurisdictions are checked on their own Act. The NSW section is the one opened for this task.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment and writes any document that will be sent, filed or signed. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Tie the opinion to the time the service was provided, and to peer professional opinion in Australia.
2. Record differing opinions as capable of being relied on, and record that universal acceptance is not required.
3. Leave the question whether the opinion is irrational to the lawyer.
4. The lawyer writes any advice. The table is not the advice.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
