## Checking plan

**Verify against sources**

The partner checks the protocol once against the current notes, and again when a note changes.

- What the AI does: Draft a firm protocol that states which New South Wales court and Commission rules apply to personal injury work, what a chronology may be used for, and what must not be generated. The partner approves it before it is issued.
- What the lawyer does: Approve the protocol against the current notes before it is issued.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. PIC13 commenced on 1 January 2026 and applies in the Workers Compensation, Motor Accidents and Police Officer Support Scheme divisions.
2. Practice Note SC Gen 23 was issued on 28 January 2025 and commenced on 3 February 2025. Paragraph 9B allows chronologies. Paragraph 10 prohibits generating the content of a person's evidence.
3. The Local Court practice note, issued 12 December 2025 and commencing 12 January 2026, adopts Practice Note SC Gen 23 for all Local Court proceedings.
4. The protocol says health and wage records stay in a firm-controlled tool, and that citation checks in submissions are done by the lawyer.

## Notes

- The Law Society list, current as at 14 May 2026, records District Court General Practice Note 2. The partner opens that note before the protocol is approved.
- This is a firm protocol, not a document for a client to sign. It is re-checked when PIC13 or Practice Note SC Gen 23 is amended.

## Practical guide

Jurisdiction: A New South Wales plaintiff firm doing personal injury work

**Deliverable**: A protocol the partner approves before it is issued.

**Inputs**

- Current PIC13, Practice Note SC Gen 23 and the Local Court practice note
- The District Court practice note, opened by the partner
- The firm's list of tools and what each tool stores

**Example**: Illustrative example: The draft protocol allows a chronology and forbids generating the content of a person's evidence. The partner adds the date each note was checked and does not issue it until the District Court note has been opened.

**Stop and escalate when**

- A court or Commission note has changed since the protocol was last approved.
- The protocol would allow client health records to be put into a public tool.

Checked 2026-10-23.
