## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the names the lawyer supplies, the tool searches the firm's records and lists possible matches against current and former clients. It does not decide whether a conflict exists, or whether consent or a barrier is available. |
| What the lawyer must review | The lawyer decides whether rules 10 or 11 apply, and whether consent or a barrier is available. The lawyer decides whether the file can be opened, and for whom. Check ASCR r 9, APP 11, and whether a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Check every instance**

The lawyer and the tool work together. The lawyer checks this output before it is used.

- What the AI does: From the names the lawyer supplies, the tool searches the firm's records and lists possible matches against current and former clients. It does not decide whether a conflict exists, or whether consent or a barrier is available.
- What the lawyer does: The lawyer decides whether rules 10 or 11 apply, and whether consent or a barrier is available. The lawyer decides whether the file can be opened, and for whom. Check ASCR r 9, APP 11, and whether a breach is notifiable under the Privacy Act 1988 (Cth).
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Check each listed name against the record the tool cites, not against the tool's summary.
2. Confirm the search used only names the lawyer supplied, and that no client information left the firm tool.
3. The lawyer, not the tool, decides whether rule 10 or rule 11 is engaged and whether consent or a barrier is available.
4. In Queensland, confirm the decision uses the Australian Solicitors' Conduct Rules 2023 as amended on 25 September 2026.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Health and client information stays in a firm-controlled tool. A public tool is not used.
- The 25 September 2026 Queensland amendment was not read rule by rule.
