## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Record the product, the work, the dates and whether it was legacy stone. Set the Victoria notification point beside the national ban. Do not decide that an offence was committed. |
| What the lawyer must review | The lawyer decides whether the work was prohibited and which compensation path is open. In Victoria, employers need not notify before permitted legacy processing. Controlled processing is still required. Confirm the Victorian regulation. The national page says implementation may vary. Do not mark re-installation as allowed. It stays with the regulator. |

## Checking plan

**Verify against sources**

The national ban is in place, and the opened Victorian difference is that employers need not notify before permitted legacy processing.

- What the AI does: Record the product, the work, the dates and whether it was legacy stone. Set the Victoria notification point beside the national ban. Do not decide that an offence was committed.
- What the lawyer does: The lawyer confirms the Victorian regulation and decides the compensation path.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The Safe Work Australia page says that from 1 July 2024 it is an offence for a person conducting a business or undertaking to carry out, or to direct or allow a worker to carry out, work involving the manufacture, supply, processing or installation of engineered stone benchtops, panels or slabs.
2. Engineered stone on that page is an artificial product with at least 1 per cent crystalline silica by weight, made by combining natural stone with other constituents such as water, resins or pigments, and hardened. The ban is only benchtops, panels and slabs that meet the whole definition.
3. For legacy stone, processing to remove, repair, make minor modifications or dispose must be controlled. In Victoria, employers are not required to notify the regulator. Elsewhere on the page, notification is required.
4. Compensation is separate. The WorkSafe page adds lung cancer with silicosis and scleroderma with silicosis as proclaimed diseases, and says a further common law application may be made for a subsequent silica-related disease if the application starts after the 2022 Act commenced.

## Notes

- The Victorian regulation text was not opened. The model page is not that text.
- Re-installation is within the model prohibition. The page says interim exemptions exist and tells the reader to ask the regulator.
- From 1 January 2025, imports of engineered stone benchtops, panels and slabs are prohibited under regulation 5M of the Customs (Prohibited Imports) Regulations 1956.

## Practical guide

Jurisdiction: Victorian engineered-stone work, and WorkSafe Victoria silica compensation

**Deliverable**: A fact sheet of the product, the work and the dates, with the state regulation marked for the lawyer to confirm.

**Inputs**

- Product description
- Work done and dates
- State of the workplace
- Diagnosis if any

**Example**: Illustrative example: In 2025 an employer removes an installed engineered-stone benchtop in Victoria. The tool records removal of legacy stone, marks that notification is not required of a Victorian employer, and marks that controlled processing is still required. The lawyer confirms the Victorian regulation before anyone calls the work lawful.

**Stop and escalate when**

- The state regulation is treated as opened.
- Re-installation is marked as allowed.
- The tool decides that an offence was committed.
