## Key facts

| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Record the product, the work and the dates, and set silicosis beside schedule 2 and the latent-onset pages. Do not treat the model ban as the Queensland regulation. |
| What the lawyer must review | The lawyer confirms the Queensland regulation before calling the work prohibited. Silicosis is a named dust-related condition. That is separate from the ban. Do not use a step from the Personal Injuries Proceedings Act 2002 for the dust injury. Do not mark re-installation as allowed. It stays with the regulator. |

## Checking plan

**Verify against sources**

Silicosis from engineered stone is a named dust-related condition in Queensland. The state ban text was not opened.

- What the AI does: Record the product, the work and the dates, and set silicosis beside schedule 2 and the latent-onset pages. Do not treat the model ban as the Queensland regulation.
- What the lawyer does: The lawyer confirms the Queensland work health and safety regulation and chooses the compensation path.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Schedule 2 names silicosis as a dust-related condition, and also has the lung, pleura or peritoneum catch-all.
2. The WorkCover latent-onset page deals with pneumoconiosis by ILO score and age, and with a terminal condition under the section 128B path.
3. Section 6(3)(b) of the Personal Injuries Proceedings Act 2002 still takes a dust-related condition outside that Act.
4. The Safe Work Australia page describes the ban from 1 July 2024 and says implementation may vary. The Queensland regulation was not opened.

## Notes

- The national definition requires at least 1 per cent crystalline silica by weight, made by combining natural stone with other constituents such as water, resins or pigments, and hardening. The ban is limited to benchtops, panels and slabs.
- Legacy processing for removal, repair, minor modification or disposal must be notified and controlled on the national page. Confirm whether Queensland follows that notification rule.
- Do not enter private, confidential, suppressed or privileged information into a public generative AI chatbot. Submissions follow Supreme Court Practice Direction 5 of 2025 or District Court Practice Direction 12 of 2025. Those directions were not opened beyond the courts page.

## Practical guide

Jurisdiction: Queensland silicosis compensation, beside the national engineered-stone ban

**Deliverable**: A fact sheet separating the compensation path from the unopened Queensland ban text.

**Inputs**

- Product and work
- Dates
- Diagnosis
- Employment

**Example**: Illustrative example: The diagnosis is silicosis after benchtop work in Queensland in 2025. The tool marks silicosis as a named dust-related condition and marks the Queensland ban text as not opened. The lawyer confirms the regulation and the compensation path separately.

**Stop and escalate when**

- The model regulation is quoted as the Queensland regulation.
- The tool decides that an offence was committed.

Checked 2026-10-23.
