| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Record the product, the work and the dates, and set them beside the SIRA eligibility points and the Monday silica list. Do not treat the model ban as the New South Wales regulation. |
| What the lawyer must review | The lawyer confirms the New South Wales regulation. The SIRA sentence was written as looking forward. Use the Monday Directions List for a silica claim, not a silicosis list. Do not treat health monitoring on the SIRA page as a compensation entitlement. Do not mark re-installation as allowed. It stays with the regulator. |

## Checking plan

**Verify against sources**

New South Wales compensation for silica remains Dust Diseases Care and the Tribunal. The state ban text was not opened.

- What the AI does: Record the product, the work and the dates, and set them beside the SIRA eligibility points and the Monday silica list. Do not treat the model ban as the New South Wales regulation.
- What the lawyer does: The lawyer confirms the New South Wales regulation and chooses Dust Diseases Care, the Tribunal, or both.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The Safe Work Australia page says the ban has been in place since 1 July 2024 and that implementation may vary. SIRA's opened text said use, supply and manufacture of all engineered stone will be prohibited from 1 July 2024.
2. SIRA says health monitoring for silica-exposed workers is mandatory under Schedule 14, Table 1 of the Work Health and Safety Regulation 2017, covering history, exposure records, a respiratory questionnaire, a respiratory function test and a full-size PA chest X-ray, at the employer's cost. That regulation was not opened.
3. Dust Diseases Care eligibility is still a covered diagnosis, exposure while employed in New South Wales, and reasonable attribution to inhalation of dust.
4. From 3 February 2025 a silicosis or other silica claim is listed in the Monday Directions List at 10am within six weeks of filing. There is no silicosis list.

## Notes

- The national page requires notification and controlled processing for permitted legacy work, with a stated Victorian exception that is not a New South Wales exception.
- The Dust Diseases Tribunal practice-notes index opened on 23 October 2026 has no generative AI note. Do not treat a Supreme Court note as the Tribunal rule. Do not enter confidential information into a public tool.
- From 1 January 2025, imports are prohibited under regulation 5M of the Customs (Prohibited Imports) Regulations 1956.

## Practical guide

Jurisdiction: Dust Diseases Care and the Dust Diseases Tribunal, for engineered-stone silica disease

**Deliverable**: A fact sheet of the exposure, the compensation path and the unopened state ban text.

**Inputs**

- Product and work
- Dates
- State of employment
- Diagnosis

**Example**: Illustrative example: A worker cut engineered-stone slabs in New South Wales and now has silicosis. The tool marks Dust Diseases Care and a Monday Directions List claim, and marks the New South Wales ban text as not opened. The lawyer confirms the regulation before anyone calls the work prohibited under a named clause.

**Stop and escalate when**

- The SIRA sentence is treated as the text of the regulation.
- The claim is placed in a silicosis list.
- The tool decides that an offence was committed.

Checked 2026-10-23.
