## Checking plan

**Verify against sources**

The lawyer checks the draft description against the records before a Victorian scheme claim is lodged.

- What the AI does: In a firm-controlled tool, compare the client's draft description of a Victorian work or transport injury with the records, and list statements the records do not support.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. List each statement about date, mechanism, body part, symptoms and time off work that the records do not support, with the page that conflicts.
2. Keep the WorkSafe written report to the employer (as soon as possible and within 30 days) separate from the TAC Part 3 claim time in section 68.
3. Do not rewrite the client's account into a verification, an authority, or a certificate.
4. Leave inconsistent accounts for the lawyer. An inconsistency may be innocent.

## Notes

- No Victorian claim form was opened that contains a statutory declaration. Do not assert that one does. Do not write into an authority or a verification part.
- Keep health, wage and scheme records in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
- If the product supports a court document, apply the note for that court: Supreme Court Practice Note SC GEN 25 (14 May 2026), the County Court practice note on artificial intelligence by court users (5 June 2026), or the Magistrates' Court guidelines issued 19 October 2026. One tool cannot verify another. Do not put confidential or sensitive information into a public tool.

## Practical guide

Jurisdiction: Victoria: description lodged with a WorkSafe claim or a TAC Part 3 claim

**Deliverable**: A marked-up comparison of the draft description against the records, for the lawyer to settle before lodgement.

**Inputs**

- Client's draft description
- Clinical records
- Wage records
- The claim form's questions

**Example**: Illustrative example: The draft says the pain started at once. The first certificate records a later onset. The tool places the two statements side by side. The lawyer decides what the lodged description says.

**Stop and escalate when**

- The draft would have to be turned into a verification or an authority.
- The supporting records are not in the file.

Checked 2026-10-23.
