| How AI is used | From the prescription and the supply record, mark a Schedule 8 supply against regulation 51, including the two-day quantity, the six-month date, and a supply contrary to the written instructions. Do not apply regulation 51 to another schedule, and do not decide negligence. |
| What the lawyer must review | Decide whether regulation 51 applies to this supply. Do not apply a Schedule 8 rule to another schedule. Do not apply regulation 53 or regulation 63. They were not opened. Keep health information in a firm-controlled tool, not a public one. |

## Checking plan

**Verify against sources**

Regulation 51 is applied only to a Schedule 8 supply by a pharmacist. The two opened consolidations use the same operative words.

- What the AI does: From the prescription and the supply record, mark a Schedule 8 supply against regulation 51, including the two-day quantity, the six-month date, and a supply contrary to the written instructions. Do not apply regulation 51 to another schedule, and do not decide negligence.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The regulation applies to an original prescription or a copy, including a digital image. It does not apply to a medicine the record does not identify as a Schedule 8 poison.
2. A quantity for more than 2 days' treatment requires a handwritten prescription where the pharmacist is familiar with the handwriting and the writing is comparable, or all reasonable steps to verify that the purported prescriber wrote it. The penalty stated is 100 penalty units.
3. No supply if it is more than 6 months since the date stated as the day the prescription was written. The penalty stated is 50 penalty units.
4. No supply where the pharmacist has reason to believe the prescription was forged, fraudulent, or altered other than by or on the instruction of the prescriber, or it is illegible or defaced, or not written in a durable form, or the permitted quantity has already been supplied. The penalty stated is 100 penalty units.
5. Other than the exceptional circumstances in regulation 53, do not supply contrary to the written instructions, including a quantity above the first occasion, a supply before a stated interval, or a different brand where only a specific brand is specified. Regulation 53 was not opened. The penalty stated is 100 penalty units.

## Notes

- The note says regulation 63 requires the pharmacist to retain the prescription if the prescriber cannot be verified and a lesser quantity is supplied. Regulation 63 was not opened.
- The www.austlii.edu.au and classic.austlii.edu.au consolidations opened on 23 October 2026 use the same operative words for regulation 51.
- Health information stays in a firm-controlled tool. Rule 9.1 of the Legal Profession Uniform Law Australian Solicitors' Conduct Rules 2015, as described by the Victorian Legal Services Board and Commissioner, and APP 11, apply. The lawyer decides whether any loss is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victoria. A pharmacist's sale or supply of a Schedule 8 poison on a prescription. Not another schedule.

**Deliverable**: A mark of the regulation 51 limit that the record engages, with regulation 53 and regulation 63 left unopened.

**Inputs**

- Prescription
- Supply record, including the date and the quantity
- The schedule the record states

**Example**: Illustrative example: The label is a Schedule 4 medicine. Regulation 51 is not applied. The lawyer names the rule for that schedule. The tool does not decide the supply was negligent.

**Stop and escalate when**

- Regulation 51 is applied to a medicine that is not Schedule 8.
- The tool decides the supply was negligent.
