| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the supply record, record whether the person is a pharmacist under Schedule 9 and whether the dealing is one that division authorises. Do not treat a blank scope column as a rule about the drug name, and do not decide negligence. |
| What the lawyer must review | The lawyer decides whether this dealing is one the schedule authorises. The blank scope column is not a checking standard for the drug name. Do not state what the Pharmacists extended practice authority allows. Health information stays in a firm-controlled tool, not a public one. |

## Checking plan

**Verify against sources**

The dealing is marked against Schedule 9, Part 1, Division 1. A blank scope column is not turned into a checking standard.

- What the AI does: From the supply record, record whether the person is a pharmacist under Schedule 9 and whether the dealing is one that division authorises. Do not treat a blank scope column as a rule about the drug name, and do not decide negligence.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Division 1 is a pharmacist registered under the National Law to practise in the pharmacy profession, excluding an intern pharmacist and a trainee pharmacist. Division 3, on the same schedule, is an intern with provisional registration employed in supervised practice, and authorises a division 1 dealing only under a pharmacist's supervision and only to the extent a pharmacist is authorised. Division 4 is a trainee registered as a student or for training, and authorises sale by retail, administration, compounding or possession of a division 1 medicine only under a pharmacist's direct supervision.
2. The dispense row authorises dispensing any medicine, and the scope column states no further condition. Do not read that blank column as a rule about the drug name, the strength or the label.
3. Stock of any medicine may be supplied on a compliant purchase order to a person under the National Health (Pharmaceutical Benefits) Regulations 2017 (Cwlth), section 33, as the table states; to another pharmacist to fill an urgent shortage, to prevent stock expiring, or to satisfy that pharmacist's client order; or from a pharmacy to an approved person, other than a pharmacist, who is authorised to give a purchase order for the medicine or administer it.
4. A treatment dose of any medicine is authorised on a standing order at a public hospital. Repackaging is for selling to a patient, supply to an approved person other than another pharmacist, or supply to or stock at a clinical area of a hospital.
5. A medicine mentioned in the extended practice authority called Pharmacists is sold or administered under that authority. The authority was not opened. Do not state what it allows.

## Notes

- The two consolidations opened on 23 October 2026 show the same dispense row, the same exclusion of interns and trainees, and the same standing-order and repackaging conditions.
- No general duty to dispense the correct medicine was opened.
- Health information stays in a firm-controlled tool. The Australian Solicitors' Conduct Rules 2023 came into force in Queensland on 27 September 2024. The Queensland Law Society page says Queensland adopted the majority of the Uniform Law changes and does not list confidentiality among the rules it kept in 2012 wording. APP 11 applies. The lawyer decides whether any loss is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland. A dealing by a pharmacist under Schedule 9, Part 1, Division 1. Interns and trainees are outside this division.

**Deliverable**: A mark of whether the opened table authorises this kind of dealing by this person.

**Inputs**

- The person's registration class
- The kind of dealing the record describes
- Any standing order or extended practice authority the record names

**Example**: Illustrative example: The record shows an intern supplied the medicine. Division 1 does not include an intern. Division 3 allows a division 1 dealing by an intern only under a pharmacist's supervision, and only to the extent a pharmacist could do it. The tool records whether supervision is shown and does not decide negligence.

**Stop and escalate when**

- A blank scope column is treated as a rule about the drug name.
- The tool states the contents of the extended practice authority.
