## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the prescription and the supply record the lawyer has selected, record who supplied the medicine, that person's role, and the limit in the section the lawyer names. Do not decide that the supply was negligent, and do not apply a Schedule 8 rule to a medicine the record does not identify as Schedule 8. |
| What the lawyer must review | The lawyer decides which supply rule applies and whether the supply broke it. Do not apply a Schedule 8 rule to another schedule. Do not use regulation 53, section 50 or the extended practice authority. They were not opened. Health information stays in a firm-controlled tool, not a public one. |

## Checking plan

**Source-by-source verification**

Use only the instrument the lawyer names, and only the schedule that instrument covers.

- What the AI does: From the prescription and the supply record the lawyer has selected, record who supplied the medicine, that person's role, and the limit in the section the lawyer names. Do not decide that the supply was negligent, and do not apply a Schedule 8 rule to a medicine the record does not identify as Schedule 8.
- What the lawyer does: The lawyer decides which supply rule applies and whether the supply broke it. A Schedule 8 rule is not applied to another schedule. Regulation 53, section 50 and the extended practice authority were not opened. Health information stays in a firm-controlled tool, not a public one.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Record the person who supplied the medicine and the role the record gives them.
2. Apply only the section the lawyer names, and only to the schedule the record identifies.
3. Do not turn an authority to dispense into a rule about checking the drug name, the strength or the label.
4. Leave regulation 53, regulation 63, section 50 and the extended practice authority blank. They were not opened past a note or a name.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Health information stays in a firm-controlled tool. Rule 9.1 of the Legal Profession Uniform Law Australian Solicitors' Conduct Rules 2015, as described by the Victorian Legal Services Board and Commissioner, and APP 11, apply. The lawyer decides whether any loss is notifiable under the Privacy Act 1988 (Cth).
- The Victorian note to regulation 51 says regulation 63 requires the pharmacist to retain a Schedule 8 prescription if the pharmacist cannot verify the prescriber and supplies a lesser quantity. Regulation 63 itself was not opened.
- The New South Wales paper-prescription rule is in the 2026 regulation. The 2008 regulation is not cited.
- No general statutory duty to dispense the correct drug was opened. Do not write one.
