## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the complaint dates and the notice dates the lawyer supplies, set out what the opened sections say a health-service complaint does to a notice deadline and to the limitation date, and if no section opened for that forum gives the complaint an effect, say so in the row. Do not decide that an excuse is made out. |
| What the lawyer must review | The lawyer decides whether a deemed excuse is made out, and whether conciliation material can be used. Do not treat a complaint as changing the date the cause of action arose, on the sections opened. Health information stays in a firm-controlled tool, not a public one. Do not copy conciliation discussions into a damages chronology. |

## Checking plan

**Source-by-source verification**

Trace relied-on content to the opened sections and check for a difference the table has missed.

- What the AI does: From the complaint dates and the notice dates the lawyer supplies, set out what the opened sections say a health-service complaint does to a notice deadline and to the limitation date, and if no section opened for that forum gives the complaint an effect, say so in the row. Do not decide that an excuse is made out.
- What the lawyer does: The lawyer decides whether a deemed excuse is made out, and whether conciliation material can be used. A complaint does not, on the sections opened, change the date the cause of action arose. Health information stays in a firm-controlled tool, not a public one. Do not copy conciliation discussions into a damages chronology.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Count the Queensland 2 years from when the claimant became aware of the matter of the complaint, and only where the complaint was about the proposed defendant.
2. Require the initial notice, or part 1, to go out as soon as practicable after the complaint is finalised. Do not stop at the complaint.
3. Do not move the limitation date because a complaint was made. No section opened does that.
4. Keep conciliation material out. Queensland uses the consents in section 149(4). New South Wales uses the consents in section 51(3). Victoria's section 43(3) was opened without a consent exception.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Health information stays in a firm-controlled tool. Rule 9.1 of the Legal Profession Uniform Law Australian Solicitors' Conduct Rules 2015, as described by the Victorian Legal Services Board and Commissioner, and APP 11, apply. The lawyer decides whether any loss is notifiable under the Privacy Act 1988 (Cth).
- Do not use the Queensland consent test on a Victorian or New South Wales file. The three sections do not say the same thing. Section 50C of the Limitation Act 1969 was opened and does not mention a health-service complaint.
