## Key facts

| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the date the lawyer says the worker was advised, and the date the written decision was received, count 20 business days for a reasons request and 3 months for a review application. List whether the decision is one of the reviewable examples on the WorkSafe page. Do not write the application. If a review decision has already been received, also count 20 business days for a Form 9 appeal. |
| What the lawyer must review | Decide whether the decision is reviewable. Not every decision is. A failure to fund one medical procedure is not a review on the page opened. Some appeals go to an Industrial Magistrate under s 548A(2), not the Commission. The lawyer decides whether to ask for more time. The tool does not. |

## Checking plan

**Verify against sources**

Queensland uses a 3-month review, not a short internal reconsideration. The appeal time is separate.

- What the AI does: From the date the lawyer says the worker was advised, and the date the written decision was received, count 20 business days for a reasons request and 3 months for a review application. List whether the decision is one of the reviewable examples on the WorkSafe page. Do not write the application. If a review decision has already been received, also count 20 business days for a Form 9 appeal.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Count the reasons request from the date the worker was advised of the decision.
2. Count the review from receipt of the written decision, lodged with the Office of Industrial Relations.
3. Match the decision to the reviewable and non-reviewable examples before treating the 3 months as available.
4. For a review decision, count 20 business days to file Form 9 where the Commission is the appeal body, and 10 business days to send a copy to Workers' Compensation Regulatory Services.

## Notes

- The review is not a court process. The review officer does not re-investigate and does not request further information.
- An Industrial Magistrate is the appeal body for the decisions QIRC lists under s 548A(2), including certain s 540(1)(a)(i) to (vi) decisions and a non-reviewable decision. Form 67 is filed in the Magistrates Court.
- A further appeal to the Industrial Court is 21 days from the Commission's or Industrial Magistrate's decision, on the pages opened.

## Practical guide

Jurisdiction: Workers' Compensation Regulator, then the Queensland Industrial Relations Commission or an Industrial Magistrate

**Deliverable**: A date table for reasons, review and, if a review decision exists, the appeal.

**Inputs**

- The decision and what it decides
- Date the worker was advised
- Date the written decision was received
- Any review decision and the date it was received

**Example**: Illustrative example: The written rejection was received on a stated Monday. The table counts 3 months from that day for a review and 20 business days from the advice date for reasons. It does not draft the application.

**Stop and escalate when**

- The decision is about ongoing management or funding one procedure.
- The appeal body might be an Industrial Magistrate and Form 9 is about to be prepared.
