## Checking plan

**Verify against sources**

The lawyer writes the application. The count shows the 60th day and whether a reason for lateness is needed.

- What the AI does: From the decision letter and the date it was received, name conciliation as the next step and count 60 days from that date. Do not write the application.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Send an Application for Conciliation within 60 days of receiving the agent's or self-insurer's decision. A late application can be considered if a reason is given. The lawyer supplies that reason.
2. Conciliation is essential before arbitration or court. If the dispute is not resolved, a genuine dispute certificate may be issued.
3. Arbitration is available if the injury date is on or after 1 September 2022, there is a genuine dispute certificate, and the dispute is about weekly payments, medical and like expenses, superannuation contributions, or interest on an outstanding amount. The arbitration page does not state a separate number of days for lodging the referral.
4. A lawyer needs the Commission's permission to attend a conciliation conference, and permission to attend an arbitration hearing. The application itself can be prepared with a lawyer's help.

## Notes

- No Workplace Injury Commission generative-AI practice note was found. If the dispute later goes to the County Court, the practice note of 9 June 2026 applies. If it goes to the Supreme Court, Practice Note SC GEN 25 applies.
- The Workers Compensation Independent Review Service is a different step. No day count for it was opened.

## Practical guide

Jurisdiction: Victoria: a WorkSafe agent or self-insurer liability decision, before the Workplace Injury Commission

**Deliverable**: A date count. The lawyer writes the application.

**Inputs**

- The decision and the date it was received
- The injury date
- Whether the dispute is about weekly payments, medical and like expenses, superannuation or interest

**Example**: Illustrative example: The decision was received 70 days ago. The count shows the 60 days have passed and leaves the reason for lateness blank. The lawyer writes the reason and the application.

**Stop and escalate when**

- The count treats a late application as out of time with no room for a reason.
- There is no date of receipt, so the 60 days cannot be counted.
