## Key facts

| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the decision and the date it was received, using a firm-controlled tool, name the Office of Industrial Relations review and the periods the review page states. Do not write the review application, and do not call a procedure refusal reviewable. |
| What the lawyer must review | You decide whether the decision is reviewable, and you write the application. If the notice stated reasons, count 3 months from receipt. If not, section 542(4) restarts that count from the reasons. Do not send the page's particular-procedure example down the review path. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The lawyer decides reviewability. The tool records the body and the periods the page states.

- What the AI does: From the decision and the date it was received, using a firm-controlled tool, name the Office of Industrial Relations review and the periods the review page states. Do not write the review application, and do not call a procedure refusal reviewable.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Match the decision to an example on the review page before calling it reviewable.
2. Record that a person may ask the insurer for reasons within 20 business days of being advised of the decision, and may lodge a review with the Office of Industrial Relations within 3 months of receiving the written decision.
3. Do not draft the application.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- The review page says a person may ask the insurer for reasons within 20 business days of being advised of the decision, and may lodge a review with the Office of Industrial Relations within 3 months of receiving the written decision. The review officer does not re-investigate and will not request further information. Examples of reviewable decisions include allowing or rejecting a claim, terminating or suspending compensation, increasing or decreasing a weekly payment, failing to decide, and the time to apply. A decision not to fund a particular medical procedure is an example of a decision that is not reviewable. Some non-reviewable decisions may be appealed to an Industrial Magistrate. Section 540 is the statutory list of reviewable decisions. Section 542(1) requires the application within 3 months after the applicant receives written notice of the decision, or the failure, and the reasons, unless section 542(4) applies. If the notice did not state the reasons, the applicant must ask within 20 business days after receiving the notice, the decision-maker must give reasons within 5 business days, and the review runs 3 months after the reasons are received.

## Practical guide

Jurisdiction: Review of a Queensland workers' compensation insurer decision

**Deliverable**: The review body and the two periods. No application.

**Inputs**

- The decision
- The date it was received
- What the decision does

**Example**: Illustrative example: The letter rejects the claim and was received on 1 June 2026. The note names a review to the Office of Industrial Relations and a 3-month period from receiving that written decision. It does not draft the application.

**Stop and escalate when**

- The decision is a refusal to fund a particular procedure.
- The received date is not known.

Checked 2026-10-23.
