## Checking plan

**Verify against sources**

The line records the declared maximum. It does not decide the severity, and it does not travel to another statute.

- What the AI does: Where the lawyer says the Civil Liability Act applies, record $829,000 as the maximum declared for section 16(2) from 1 October 2026, and leave the percentage of a most extreme case blank. Where the lawyer has not accepted that Act, leave the dollar blank. Do not write a schedule that will be filed or served.
- What the lawyer does: Accept the figure and the statute before the line is used.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The Civil Liability (Non-economic Loss) Order 2010, clause 3, declares for Civil Liability Act section 17(1) the amount that applies for section 16(2). For 1 October 2026 the table states $829,000.
2. Section 16 does not allow non-economic loss unless the severity of the loss is at least 15 per cent of a most extreme case. The tool does not decide that percentage, and it does not convert a whole person impairment into a proportion of a most extreme case.
3. Do not use $829,000 for non-economic loss under Motor Accident Injuries Act section 4.11, or for work injury damages. Section 16 is not one of the provisions section 3B(2) keeps for a Part 4 award. Section 3B(1)(f) takes work injury damages outside the Act other than Part 1B.
4. Leave the dollar blank until the lawyer accepts both the Civil Liability Act and the date.

## Notes

- The Order's table is the maximum for section 16(2). It is not an amount for a lesser injury.
- Health and wage records stay in a firm-controlled tool. The lawyer applies ASCR r 9 and APP 11, and decides whether any breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales

**Deliverable**: A line recording the declared maximum, or a blank, with no percentage.

**Inputs**

- Whether the lawyer says the Civil Liability Act applies
- The date of the assessment

**Example**: Illustrative example: The claim is a public-liability claim assessed in October 2026. The line records $829,000 as the section 16(2) maximum. The percentage cell stays blank.

**Stop and escalate when**

- The claim is a Part 4 motor accident award.
- The tool would choose the percentage of a most extreme case.
