## Checking plan

**Verify against sources**

The lawyer applies section 232 and decides whether an exception is met. No TAC end date was opened.

- What the AI does: Record the section 232 cessation rules for Victorian medical and like expenses, including the notice and the exceptions. Do not decide that an exception is met, and do not apply an impairment-banded duration.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. If weekly payments are payable, compensation under the Division ceases 52 weeks after the weekly-payment entitlement ceases, unless subsection (5) applies, and subject to subsection (4).
2. If compensation is payable only under the Division, it ceases 52 weeks after the entitlement arises, unless subsection (5) applies, and subject to subsection (4).
3. Before cessation under subsection (1) or (2), the Authority or self-insurer must give at least 28 days' written notice stating the reasons and the cessation date.
4. Subsection (4): it does not cease under (1) or (2) if the worker receives a pecuniary-loss damages settlement or award under section 325 or Transport Accident Act section 93, or accepts a voluntary settlement of weekly payments under Division 9. Subsection (5): it does not cease if the worker returned to work but could not remain without a section 224(1) service, or surgery is required, or a prosthesis modification is required, or a section 224(1) service is essential so that health or activities of daily living do not significantly deteriorate.

## Notes

- The WorkSafe treatment-expenses page says WorkSafe can pay the reasonable cost of approved services and that there may be a gap. It does not state the 52-week rule. Use the Act.
- Section 224 was not relied on beyond the cross-reference in section 232. No TAC medical-duration end date was opened. Do not write that TAC treatment continues for life or ends on an impairment band.
- The WIRC Act index notes a 2026 amending Act. The section 232 text opened shows 2014 amendment notes only. The lawyer confirms the current instrument. Keep health, wage and scheme records in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victoria: medical and like expenses under the WIRC Act, with no TAC end date invented

**Deliverable**: A duration note stating which subsection applies on the instructions, the notice requirement, and the exceptions still to be decided.

**Inputs**

- Whether weekly payments are or were payable
- The date the weekly entitlement ceased, or the medical-only entitlement arose
- Any damages settlement or Division 9 settlement
- Any surgery, prosthesis or section 224 service in issue

**Example**: Illustrative example: Weekly payments ceased on a stated day and no damages have been awarded. The tool counts 52 weeks from that day and notes the 28-day notice. It lists subsection (5) and leaves each exception undecided. The lawyer decides whether any exception is met.

**Stop and escalate when**

- An impairment percentage is about to be used to choose a two-year, five-year or life period.
- A TAC medical end date is about to be stated.
- An exception is about to be treated as already established.

Checked 2026-10-23.
