| How AI is used | In a firm-controlled tool, list each funeral invoice against section 66(2)(d)(i) of the Succession Act 1981, and flag a WorkSafe payment that covers the same cost. Do not invent a dollar cap. |
| What the lawyer must review | Decide whether the estate head or the scheme carries each invoice. Part 10, as opened, creates no funeral head. The WorkSafe page states no dollar cap. Do not add one. |

## Checking plan

**Queensland funeral head**

The tool lists funeral invoices against Succession Act s 66(2)(d)(i). Part 10 creates no funeral head on the text opened.

- What the AI does: In a firm-controlled tool, list each funeral invoice against section 66(2)(d)(i) of the Succession Act 1981, and flag a WorkSafe payment that covers the same cost. Do not invent a dollar cap.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Tie each amount to an invoice.
2. Keep the funeral sum in the estate column, not in Part 10.
3. Record section 70 before treating an insurance, superannuation or statutory payment as a reduction of Part 10 damages.
4. Copy no cap that the page does not state.

## Notes

- Section 66(2)(d)(i) of the Succession Act 1981 allows a sum for funeral expenses in the estate's damages where the wrong caused the death. The opened Part 10 of the Civil Proceedings Act 2011 does not create a funeral head. The WorkSafe Queensland page says compensation when somebody has died might be a lump sum, quarterly payments, or help with funeral costs. It states no dollar cap. Section 70 says the Part 10 assessment must not take into account, to reduce the damages, an amount paid or payable on the death under a contract of insurance, under a contract other than insurance with a friendly society, benefit society, association or trade union, out of a superannuation, provident or similar fund, or by way of a pension, benefit or allowance under a law of the Commonwealth, a State or another country, or a gratuity.
- Family, wage and medical records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland: estate damages under Succession Act 1981 s 66, and a WorkSafe funeral payment where that scheme applies

**Deliverable**: An invoice table with the estate head marked and any scheme payment flagged.

**Inputs**

- Funeral invoices
- Any WorkSafe payment record
- The opened sections

**Example**: Illustrative example: A family member asks for a capped refund of funeral invoices under Part 10. The tool records that the opened Part 10 has no funeral head and no dollar cap. The lawyer decides the estate claim and any scheme help.

**Stop and escalate when**

- A dollar cap is proposed that the page does not state.
- The invoice is claimed in both columns.
