| How AI is used | In a firm-controlled tool, set out the gross sum, each amount an opened section brings to account, the costs figure the lawyer supplies, and who is to receive or hold the balance. The tool does not calculate costs and does not settle the net figure. |
| What the lawyer must review | Check every figure, supply the costs amount, and decide who may be paid. Apply the holding rule before treating a payment to the solicitor as permitted. Leave Medicare, Centrelink and NDIS figures to be taken from their own clearances. |

## Checking plan

**Verify against sources**

The lawyer checks the net sum. The statement uses section 93 or section 343 and does not assess costs.

- What the AI does: In a firm-controlled tool, set out the gross sum, each amount an opened section brings to account, the costs figure the lawyer supplies, and who is to receive or hold the balance. The tool does not calculate costs and does not settle the net figure.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Start from the gross sum the lawyer accepts. Add only exclusions and reductions from section 93 or section 343.
2. Costs are an input the lawyer supplies. This statement does not assess them.
3. If money is to be paid into court, follow the authenticated order and the time it limits.
4. Do not treat a TAC medical and like expense as repaid if the lawyer says it continues.

## Notes

- Payment into court follows the authenticated order, within the time the order limits, as Funds in Court describes. Transport Accident Act 1986 sections 93(10), (11) and (11A) are the opened exclusions and reductions for a transport accident. The TAC page says the repayment is usually offset against the damages, that medical and like expenses generally continue, and that Senior Master's Office or administrative fees may be considered as part of a pecuniary loss settlement. It also says the TAC will not apply sections 93(10) and 93(11) where the losses were paid under the Act the page names as the Safety Rehabilitation and Compensation Act 1988.
- For a workplace damages payout, section 343 is the opened reduction. Subsection (2) puts that reduction of a judgment before any Wrongs Act section 26(1) reduction. Costs are an input the lawyer supplies. This statement does not assess them and does not settle the net figure.

## Practical guide

Jurisdiction: Victoria: net sum after statutory compensation is brought to account

**Deliverable**: A net-sum statement showing the gross sum, each opened deduction or exclusion, the lawyer's costs figure, and who holds the balance.

**Inputs**

- The gross sum
- Compensation figures the lawyer accepts
- The costs figure the lawyer supplies

**Example**: Illustrative example: The gross sum is agreed. The statement takes off the section 93(11) amounts the lawyer lists, inserts the costs figure the lawyer supplies, and names Funds in Court as the holder because the order says so. It does not calculate costs.

**Stop and escalate when**

- The tool would assess costs.
- The tool would settle the net figure as payable to the solicitor.
