## Checking plan

**Verify against sources**

The lawyer writes anything that is sent. The index lists questions and documents. It is not the referral.

- What the AI does: From the reports the lawyer has selected, on a firm-controlled tool, index the documents and list medical questions in the lawyer's words. Do not write the referral that is lodged.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Medical Panels receives workers compensation referrals and Wrongs Act referrals. On a WorkSafe dispute, the Workplace Injury Commission page says a conciliation officer may refer a medical question for an opinion that is binding and must be accepted.
2. The opened pages do not say the worker lodges that referral. Do not prepare a worker's lodging form for it.
3. Once the opinion has issued, the panel cannot reopen the matter. For most WorkCover cases the opinion takes about four weeks from the appointment.
4. Each question stays a medical question. Liability, weekly payments and the reading of the Act are not medical questions.

## Notes

- No Workplace Injury Commission generative-AI practice note was found. If the same questions are later used in the County Court, the practice note of 9 June 2026 applies, including its caution on expert reports.
- The tool writes none of the panel opinion and none of an expert report.

## Practical guide

Jurisdiction: Victoria: a medical question in a WorkSafe conciliation, or a Wrongs Act medical panel

**Deliverable**: An internal index of documents and questions.

**Inputs**

- The reports the lawyer has selected
- The questions in the lawyer's words
- Whether a conciliation officer is the referrer

**Example**: Illustrative example: The draft question asks whether the employer is liable. The index moves that question out of the medical list. The lawyer writes any referral. The index is not sent.

**Stop and escalate when**

- The index is being lodged as the referral.
- A question asks the panel to decide liability or to calculate compensation.
