## Checking plan

**Victorian particulars, written by the lawyer**

The tool lists candidates from the documents. The lawyer writes the section 21 particulars that are delivered with the statement of claim.

- What the AI does: In a firm-controlled tool, list each person, relationship, date of birth and employer entry the documents state. Do not write the particulars that will be filed.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Include the persons, the nature of the claim, dates of birth, and the employers, dates and net earnings in the twelve months before the injury.
2. Take the net sum from the wage records, after tax.
3. Read Practice Note SC Gen 25 before any generated text is used in a Supreme Court pleading.
4. Deliver one set of particulars for all the persons, with the statement of claim.

## Notes

- Section 21 of the Wrongs Act 1958 requires the plaintiff, together with the statement of claim, to deliver full particulars of the persons for whom and on whose behalf the action is brought, the nature of the claim, the date of birth of each such person and of the deceased, the name and address of each employer of the deceased in the twelve months before the injury that caused the death, the start and duration of each employment, and the total net sum, after tax, that the deceased earned in that twelve months. Practice Note SC Gen 25 treats pleadings as court documents.
- Family, wage and medical records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victoria: particulars under Wrongs Act 1958 s 21, delivered with the statement of claim. Supreme Court Practice Note SC Gen 25 applies to pleadings in that court.

**Deliverable**: A source-tagged list for the lawyer who writes the filed particulars.

**Inputs**

- Family documents
- Wage records for the twelve months
- Dates of birth
- Practice Note SC Gen 25

**Example**: Illustrative example: The tool lists three people and the employers shown on the wage records. Section 21 requires those particulars with the statement of claim. The lawyer writes the document that is filed and checks every figure.

**Stop and escalate when**

- The tool's list would be filed or annexed as the particulars.
- A net sum cannot be tied to a wage record.

Checked 2026-10-23.
