| How AI is used | In a firm-controlled tool, list each family member the documents show suffered damage. Do not write the originating process, and do not add an earnings list Part 10 does not require. |
| What the lawyer must review | You write the originating process. The tool's list is not filed. One proceeding only, for the family members who suffered damage. A notice by a person who can sue is taken to be given for all of them. |

## Checking plan

**Queensland proceeding, written by the lawyer**

The tool lists the family members the documents show suffered damage. The lawyer writes the one proceeding. Part 10 does not prescribe an earnings list.

- What the AI does: In a firm-controlled tool, list each family member the documents show suffered damage. Do not write the originating process, and do not add an earnings list Part 10 does not require.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Do not require dates of birth, employers or a twelve-month net sum. The opened Part 10 does not.
2. Apply section 65(1): not more than one proceeding against a person in relation to a death.
3. Section 65(4) allows an application to the Supreme Court for directions before starting. The lawyer decides whether to apply.
4. The Queensland Courts page names practice directions. Their text was not opened, so their directions are not set out.

## Notes

- The opened Part 10 does not prescribe the list of particulars in the Victorian section. Section 65(1) allows not more than one proceeding against a person in relation to a death. Section 65(3) says a notice given under an Act by a person able to bring the proceeding is taken to have been given on behalf of all members of the family who suffered damage. Section 65(4) lets a person able to bring the proceeding apply to the Supreme Court for directions about the steps required before starting it. The Queensland Courts page directs lawyers to the practice direction on accuracy of references for the court in which the document is filed. The text of those practice directions was not opened.
- Family, wage and medical records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland: one proceeding under Civil Proceedings Act 2011 Part 10. Directions before start may be sought from the Supreme Court under s 65(4).

**Deliverable**: A source-tagged list of family members for the lawyer who writes the proceeding.

**Inputs**

- Family documents
- Who suffered damage
- Any notice already given
- The Queensland Courts generative AI page

**Example**: Illustrative example: The tool lists the spouse and two children the documents show were supported. It does not draft the claim. The lawyer writes the one proceeding and decides whether to seek directions under section 65(4).

**Stop and escalate when**

- A second proceeding would be filed for a family member.
- The text of an unopened practice direction is stated.

Checked 2026-10-23.
