## Checking plan

**New South Wales particulars, written by the lawyer**

The tool lists the persons the documents name. The lawyer writes the section 6 particular delivered with the declaration. The opened section does not require an earnings list.

- What the AI does: In a firm-controlled tool, list each person for whom the action may be brought and the relationship the documents state. Do not write the particular that will be delivered with the declaration.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Include the persons for whom and on whose behalf the action is brought, and the nature of the claim.
2. Section 7 says declaration includes any statement of the cause of action appropriate to the court.
3. Do not require dates of birth, employers or net earnings. The opened section does not.
4. Practice Note SC Gen 23 was not opened. Do not set out its directions.

## Notes

- Section 6 of the Compensation to Relatives Act 1897 requires the plaintiff, together with the declaration, to deliver a full particular of the persons for whom and on whose behalf the action is brought, and of the nature of the claim. Section 7 says declaration includes any statement of the cause of action appropriate to the court. The opened section does not require the Victorian list of dates of birth, employers and net earnings. The Supreme Court page says Practice Note SC Gen 23 was amended on 28 January 2025, effective 3 February 2025. The practice note itself was not opened, so its directions are not set out here.
- Family, wage and medical records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales: a particular under Compensation to Relatives Act 1897 s 6, delivered with the declaration. Practice Note SC Gen 23 was not opened.

**Deliverable**: A source-tagged list of persons for the lawyer who writes the filed particular.

**Inputs**

- Family documents
- The nature of the claim
- The Supreme Court generative AI page

**Example**: Illustrative example: The tool lists the spouse and the children named in the documents. Section 6 requires a full particular of those persons and of the nature of the claim. The lawyer writes it. The practice note's directions are not guessed.

**Stop and escalate when**

- The tool's list would be delivered as the particular.
- Directions from the unopened practice note are stated.

Checked 2026-10-23.
