## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the documents the lawyer selects, list each potential claimant, the relationship the document states, any date of birth the document states, and the page. Do not write the particulars that will be filed. |
| What the lawyer must review | You write every particular that is filed. Nothing the tool drafts is put into that document. Check each name, relationship, date of birth and earnings figure against the source document. Family, wage and medical records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Filed particulars written by the lawyer**

The tool lists candidates from the documents. The lawyer writes the particulars that are filed with the claim.

- What the AI does: From the documents the lawyer selects, list each potential claimant, the relationship the document states, any date of birth the document states, and the page. Do not write the particulars that will be filed.
- What the lawyer does: You write every particular that is filed.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer writes the document that is filed. The tool's list is not filed.

## Checks the lawyer makes

1. Include only the items the opened section requires, and take earnings from the wage records for the period that section states.
2. The list is not filed. You write the particulars and check every figure before they are delivered.
3. Read the generative AI practice note of the court in which the proceeding is filed before any generated text is used.
4. One proceeding only, for all the people the section names. Do not start a second action for a person left off the list.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Supreme Court of Victoria Practice Note SC Gen 25 was issued and commenced on 14 May 2026. It applies to court users, and a court document includes pleadings. The Queensland Courts page directs lawyers to Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025 on the accuracy of references in submissions. The Supreme Court of New South Wales page says Practice Note SC Gen 23 was amended on 28 January 2025 and the amendments came into effect on 3 February 2025. Read the note for the court in which the proceeding is filed.
