## Checking plan

**Verify against sources**

The lawyer writes the Victorian particulars. The tool extracts figures for the statement-of-claim particulars and the pre-trial update.

- What the AI does: From the records the lawyer selects, extract the figures and document references for particulars served with the statement of claim, and for the County Court final particulars within 28 days of trial. The tool does not write the particulars.
- What the lawyer does: Write the particulars and decide which records are served with them.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Practice Note SC CL 3 paragraph 3.2 expects that, when a writ in a List is served, the plaintiff can serve a statement of claim in the time the 2025 rules allow, can serve critical documents, including relevant medical and economic-loss records, with the statement of claim, and, where appropriate, can serve a Wrongs Act certificate of assessment.
2. The key documents file should not include medical records or tax documents as a matter of course. Do not paste them into that file to stand as particulars.
3. County Court General List standard orders allow updated reports and final particulars of special damages, loss of earnings and loss of earning capacity within 28 days of trial.
4. Those orders do not allow a new expert, or wholly new material, without leave.

## Notes

- Practice Note SC GEN 25, issued on 14 May 2026, covers Supreme Court documents, including pleadings, submissions and expert reports. Do not put confidential or sensitive material into a public AI tool.
- Rule 9.1, APP 11 and the notifiable-breach test apply to the wage and clinical records used to build the figures.

## Practical guide

Jurisdiction: Supreme Court of Victoria personal injury lists under Practice Note SC CL 3, or the County Court General List

**Deliverable**: A source-tagged figures table. The lawyer writes the particulars.

**Inputs**

- Wage records, accounts and the medical chronology selected by the lawyer
- The court and the trial date
- The current list orders

**Example**: Illustrative example: A new specialist is named in particulars served 20 days before a County Court trial. The checklist marks paragraph 22.9. The lawyer decides whether to seek leave.

**Stop and escalate when**

- A figure cannot be tied to a document the lawyer has selected.
- The tool is asked to write the particulars that will be served.

Checked 2026-10-23.
