## Key facts

| Fact | Value |

| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the facts about the injured person's own conduct, build an issues table for a contributory negligence reduction. The lawyer names the civil liability statute. Where that statute is the Civil Liability Act 2002 (NSW), use ss 5R and 5S. The tool does not choose a percentage. |
| What the lawyer must review | The lawyer decides whether there was contributory negligence, the standard of care, and the reduction, including whether a 100 per cent reduction is open, and writes the advice. Other jurisdictions are checked on their own Act. |

## Checking plan

**Reduction decided by the lawyer**

The tool sets out the statutory questions. The lawyer decides whether there was contributory negligence and the reduction.

- What the AI does: From the facts about the injured person's own conduct, build an issues table for a contributory negligence reduction. The lawyer names the civil liability statute. Where that statute is the Civil Liability Act 2002 (NSW), use ss 5R and 5S. The tool does not choose a percentage.
- What the lawyer does: The lawyer decides whether there was contributory negligence, the standard of care, and the reduction, including whether a 100 per cent reduction is open, and writes the advice. Other jurisdictions are checked on their own Act.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Where the Civil Liability Act 2002 (NSW) applies, use the standard of a reasonable person in the position of the person who suffered harm, on what that person knew or ought to have known at the time.
2. Record whether a complete reduction is open on the statute being applied. Under s 5S of that Act a court may determine a reduction of 100 per cent if it thinks it just and equitable.
3. The lawyer chooses the percentage and writes the advice.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
