## Checking plan

**Verify against sources**

The lawyer writes the questions. The tool applies the Victorian number and subject limits.

- What the AI does: From the pleading and the lawyer's issue list, list the liability topics the practice note allows and the topics it disallows. The tool does not write the interrogatories.
- What the lawyer does: Write the interrogatories. The tool only lists the allowed and disallowed topics.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Practice Note SC CL 3 limits interrogatories in a List to 30, including sub-parts.
2. In a motor vehicle or industrial accident case they are confined to liability and contributory negligence unless the Court directs otherwise.
3. County Court paragraph 8.8 confines interrogatories to questions of liability. Paragraph 8.9 generally disallows evidentiary matters, the identity of possible witnesses, and matters that belong in medical reports or particulars of special damage or loss of earnings.
4. Paragraph 8.7 states a limit of 30, including sub-parts, for the Civil Claims Lists. Leave is required to exceed it. A self-represented party must seek leave to administer interrogatories.

## Notes

- Practice Note SC GEN 25, issued on 14 May 2026, covers Supreme Court documents, including pleadings, submissions and expert reports. Do not put confidential or sensitive material into a public AI tool.
- The County Court number limit in paragraph 8.7 is stated for the Civil Claims Lists. Do not treat it as a General List number unless the note is read that way for the particular list.

## Practical guide

Jurisdiction: Supreme Court of Victoria personal injury lists, or the County Court Common Law Division

**Deliverable**: A topic list. The lawyer writes the interrogatories.

**Inputs**

- The pleadings
- The lawyer's liability issues
- The court and list

**Example**: Illustrative example: The topic list includes a question about loss of earnings. The checklist marks paragraph 8.9. The lawyer removes it.

**Stop and escalate when**

- The count, including sub-parts, would exceed 30 in a Supreme Court list.
- The tool is asked to serve the questions.

Checked 2026-10-23.
