## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | Extract a dated chronology of exposure, diagnosis and scheme steps from the records for a Victorian dust-disease matter. Do not decide the pathway and do not write a court document. |
| What the lawyer must review | Decide whether section 23AB applies. The dust definition was not opened. Decide the List steps and whether a statutory path also exists. The tool extracts the chronology. It writes nothing for the Court. |
| Written for | Victoria |
| Applies to | [Prepare an occupational-disease or dust-disease file chronology and issues list](https://ailawframework.com/practice/personal-injury-and-compensation/prepare-an-occupational-disease-or-dust-disease-file-chronology-and-issu.md) |

## Checking plan

**Verify against sources**

The lawyer decides the pathway and what goes to the Dust Diseases List. The tool only extracts a chronology.

- What the AI does: Extract a dated chronology of exposure, diagnosis and scheme steps from the records for a Victorian dust-disease matter. Do not decide the pathway and do not write a court document.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Build the chronology from source pages: exposure, employer, diagnosis, and any statutory claim. Do not add a medical conclusion.
2. The Supreme Court Dust Diseases List manages all proceedings in which a plaintiff alleges a dust related condition. After appearance the Court issues a timetable. A summons for directions is not needed. Trial management directions are usually two to three weeks after mediation and can be on the papers if the timetable is met.
3. Friday directions are before a Judicial Registrar, other than non-sitting dates. A summons may be returnable on any Friday more than seven days ahead without a registry return date. The list email on the page is dust.diseases@supcourt.vic.gov.au.
4. Section 27B(2)(d) takes Part IIA off a dust-related condition as defined in the Administration and Probate Act 1958. Section 23AB can remove the limitation period for a worker or dependants in the actions it names. The definition was not opened. The lawyer decides whether it applies.

## Notes

- No separate urgent-hearing rule for a terminally ill plaintiff was found on the List page. Do not invent one. The Court expects efficient conduct under the Civil Procedure Act 2010 (Vic).
- WIRC Act index headings for serious dust-related awards were seen and the sections were not opened. Do not state what they do.
- If a document is to be filed in the Supreme Court, Practice Note SC GEN 25 applies. The tool writes nothing that is filed. Keep health, wage and scheme records in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victoria: Supreme Court Dust Diseases List, and any related statutory dust claim

**Deliverable**: A source-linked chronology and a list of open pathway questions, with no court document.

**Inputs**

- Exposure and employment records
- Diagnosis
- Any statutory claim documents
- Whether a proceeding is contemplated

**Example**: Illustrative example: The records show exposure with two employers and a later diagnosis. The tool dates each source. The lawyer decides whether section 23AB applies and whether the matter is entered in the Dust Diseases List. Nothing is prepared for filing.

**Stop and escalate when**

- The output would be filed, or would decide that section 23AB applies.
- The dust definition is about to be assumed without being opened.
