## Checking plan

**Verify against sources**

The lawyer decides the deduction and any dispute. The table records the manual's hearing-loss rules. It does not convert a percentage.

- What the AI does: From the audiograms and the employment history the lawyer supplies, on a firm-controlled tool, table the dates, the whole-person figures and the employers. Do not convert a figure unless the opened page states the conversion.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The claims manual says the hearing-loss threshold is 10 per cent whole person impairment, and that it need only be met once. A later claim does not have to meet it again.
2. Where there is an earlier Victorian hearing-loss payment, the dollar amount paid is deducted from the later dollar entitlement. The percentage is not deducted. The assessor is not asked to deduct the prior percentage.
3. Employment must be considered as a significant contributing factor. The worker's consent is required before information is sought from an interstate employer or insurer. Where part of the loss is treated as interstate, the manual describes a percentage deduction on a time-weighted scale.
4. If the worker disputes a notice of entitlement because of an interstate deduction, the manual says the appeal lies in the County Court.

## Notes

- No conversion from a binaural percentage to whole person impairment was set out on the page. Do not invent one.
- A County Court challenge is written by the lawyer and verified under the practice note of 9 June 2026. Audiograms stay in a firm-controlled tool.

## Practical guide

Jurisdiction: Victoria: a WorkSafe hearing-loss impairment benefit

**Deliverable**: A hearing-loss table. The lawyer decides any deduction and any County Court step.

**Inputs**

- The audiograms and the whole-person figure, if one has been issued
- Any earlier Victorian hearing-loss payment, in dollars
- Interstate employment and whether the worker consents to enquiries

**Example**: Illustrative example: An earlier Victorian payment is recorded on a notice and the new assessment is above 10 per cent. The table shows a dollar deduction only from the figure on that notice, and it does not deduct the old percentage. It does not convert a binaural figure.

**Stop and escalate when**

- The table converts a hearing figure to a whole-person impairment without a conversion on the opened page.
- The table seeks interstate records without the worker's consent.
