## Checking plan

**Verify against sources**

The lawyer prepares the request. The tool lists the addressees. The subpoena itself is not filed.

- What the AI does: From the lawyer's list of hospitals and treating practitioners, draft the request: the name, the date range and the classes. The tool does not file the request or write the subpoena.
- What the lawyer does: Settle the request that is filed. The registrar issues the subpoena.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Rule 414 allows a subpoena to attend, to produce, or to do both, on the court's initiative or at a party's request.
2. The court file gets the request. The subpoena, once issued, is not filed.
3. Name the person, or describe the office or position, unless the registrar otherwise directs or the court otherwise orders. One request may ask for more than one subpoena.

## Notes

- Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025 require a named practitioner to verify references in submissions. They are not a ban on generative AI in evidence.
- The Queensland Courts generative AI page says not to enter private, confidential, suppressed or privileged information into a public chatbot.

## Practical guide

Jurisdiction: A Queensland proceeding in which a subpoena is issued under rule 414

**Deliverable**: A schedule for the request. The lawyer writes the request. The subpoena is not filed.

**Inputs**

- The hospitals and treating practitioners
- The date range for the injury
- Whether the registrar has directed that a name may be omitted

**Example**: Illustrative example: The draft includes the subpoena in the filing. The checklist removes it and leaves the request. The lawyer files the request only.

**Stop and escalate when**

- The person to be named is unknown and no direction has been given.
- The tool is asked to file the subpoena.
