## Checking plan

**Lawyer-led subpoena**

The lawyer settles and issues the subpoena. The tool lists addressees and date ranges from the records index.

- What the AI does: From the lawyer's list of hospitals and treaters, draft a schedule of addressees, date ranges and document classes for the lawyer to settle. The tool does not write the subpoena or the request that is filed.
- What the lawyer does: The lawyer settles the addressee, the date range and the classes, and issues the subpoena. Check whether leave is required before the timetable, and the return date. Agree any redaction of third-party or sensitive entries before production is inspected. Decide whether a loss likely to result in serious harm must be notified under the Privacy Act.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer writes anything filed with the court or signed by the client. The tool may organise, extract, compare, index or comment.

## Checks the lawyer makes

1. Name the addressee as the rules require, and limit the date range to the injury.
2. In Victoria, do not issue a production subpoena before a defence is filed without leave, where the practice note requires that leave.
3. In Queensland, file a request for the registrar to issue the subpoena. The subpoena itself is not filed.
4. Tell the other parties which records are sought so objections can be raised before the return.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
