| How AI is used | From the police report and the searches the lawyer selects, list what was done to identify the vehicle and the dates of those steps. Do not say the search was enough. |
| What the lawyer must review | You decide whether the attempt to identify the vehicle is enough, and who is notified. Check the three-month notice and the nine-month bar before any late Nominal Defendant claim. For an uninsured vehicle, check that the accident was on a road or in a public place. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The lawyer decides if the Nominal Defendant is the right respondent and if notice is still in time.

- What the AI does: From the police report and the searches the lawyer selects, list what was done to identify the vehicle and the dates of those steps. Do not say the search was enough.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. List the identification steps and their dates.
2. Apply the three-month and nine-month rules only to a vehicle that cannot be identified.
3. For an uninsured vehicle, record the place of the accident.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- The Commission's claim page says an unidentified vehicle, or a vehicle that was required to be registered but was not, is claimed against the Nominal Defendant after a genuine attempt to identify it. The same page says a vehicle that is not eligible for registration, and gives e-bikes and scooters as examples, is unlikely to have a compulsory third-party claim accepted. That sentence is the Commission's guidance. It is not a section of the Act.
- Section 37(2) requires notice within 3 months where the vehicle cannot be identified. Section 37(3) bars the claim against the Nominal Defendant if that notice is not given within 9 months. Section 39(8) says the Nominal Defendant cannot waive that failure and the court cannot give leave to proceed despite it. Section 5(2): for an uninsured motor vehicle, the Act applies only if the accident happens on a road or in a public place.

## Practical guide

Jurisdiction: Queensland Nominal Defendant claims

**Deliverable**: A search chronology for the lawyer. No conclusion that the search was enough.

**Inputs**

- The police report
- The searches
- The accident place

**Example**: Illustrative example: The report says the other vehicle did not stop, and the only search is dated four months later. The list records that gap. It does not say the Nominal Defendant claim is still open.

**Stop and escalate when**

- No search steps are recorded.
- Nine months have passed on an unidentified vehicle and the output would still prepare the claim as of right.
