| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the accident facts the lawyer marks, record that a statutory-benefits claim is made on the Nominal Defendant and the 28-day weekly-payment consequence in clause 4.16. Do not decide fault, and do not complete the claim form. |
| What the lawyer must review | Decide whether the other vehicle is unidentified or uninsured, and who must be claimed against. Weekly payments from the day after the accident need a Nominal Defendant claim within 28 days. If the at-fault vehicle is registered outside New South Wales, follow clause 4.39. Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test. |

## Checking plan

**Verify against sources**

The lawyer identifies a Nominal Defendant claim and the 28-day consequence. The tool does not decide fault.

- What the AI does: From the accident facts the lawyer marks, record that a statutory-benefits claim is made on the Nominal Defendant and the 28-day weekly-payment consequence in clause 4.16. Do not decide fault, and do not complete the claim form.
- What the lawyer does: Decide whether the Nominal Defendant is the right respondent, and settle the claim.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Clause 4.16: where the at-fault vehicle is unidentified or uninsured, the statutory-benefits claim is made on the Nominal Defendant. A claim within 28 days is required for weekly payments from the day after the accident.
2. Clause 4.39: if the vehicle considered at fault was registered outside New South Wales, the New South Wales insurer managing statutory benefits for the Nominal Defendant gives that insurer a copy of each liability notice, including the notice for benefits after 52 weeks.
3. Section 6.13 still sets the 3-month claim time and the late-claim test. Clause 4.16 does not replace it.
4. Do not complete the claim form. Do not decide which vehicle was at fault.

## Notes

- The guidelines use Nominal Defendant for the unidentified or uninsured vehicle. No separate Nominal Defendant provision of the Act was opened beyond the guidelines and section 6.13.

## Practical guide

Jurisdiction: Motor Accident Guidelines clause 4.16, Nominal Defendant, for an accident on or after 1 December 2017

**Deliverable**: A claim note naming the Nominal Defendant and the 28-day weekly-payment consequence. The form is not completed.

**Inputs**

- Accident date
- What is known about the other vehicle
- Registration place, if known

**Example**: Illustrative example: The other vehicle left the scene and is unidentified. The tool records a Nominal Defendant claim and the 28-day consequence for weekly payments from the day after the accident. It does not fill in the form.

**Stop and escalate when**

- It is not yet known whether the other vehicle is unidentified, uninsured or registered outside New South Wales.
- The tool is asked to decide fault.
