## Checking plan

**Verify against sources**

The lawyer chooses the appeal body, the grounds and the facts. The tool only organises the file the lawyer has selected.

- What the AI does: From the review decision and the medical and wage material the lawyer selects, draft a chronology and an issues list for a QIRC appeal. Do not write the grounds or the statement of facts and contentions.
- What the lawyer does: The lawyer decides whether to appeal, settles the statement of facts and contentions, and authorises anything filed.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Read the decision and confirm the appeal body under section 548A. A review decision is appealed to the QIRC against the Regulator by Form 9. An industrial magistrate hears a Regulator decision under section 107E, a Regulator decision under section 540(1)(a)(i) to (vi), or a non-reviewable decision. Serve a non-reviewable appeal on the insurer under section 550(6).
2. Diary 20 business days from the day the review decision was received. The QIRC page says a Form 9 appeal is filed within that period.
3. Match every fact in the draft chronology to a document the lawyer has selected. Leave medical opinions as the assessor's words.
4. Before any submission is filed, name the individual practitioner who takes responsibility, under QIRC Practice Direction 1 of 2026.

## Notes

- A compensation conference at the QIRC is not a settlement conference. The Commission's page says no commercial settlement is possible there.
- Practice Direction 1 of 2026 requires the responsible person to verify legislation and authorities. The tool's chronology is not that verification.
- Medical and wage records stay in a firm-controlled tool. Apply ASCR r 9 and APP 11, and consider whether a breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland Industrial Relations Commission, appeal against a Workers' Compensation Regulator review decision

**Deliverable**: A chronology and issues list for the lawyer to use in settling a Form 9 appeal and a statement of facts and contentions.

**Inputs**

- The Regulator's review decision and the date it was received
- Lawyer-selected medical reports and wage records
- The insurer's reasons

**Example**: Illustrative example: The draft lists a disputed diagnosis as proved. The lawyer deletes it because the report only records the worker's account, and the lawyer writes the contention.

**Stop and escalate when**

- The appeal period may have expired, or the correct appeal body is unclear.
- A fact in the draft has no document on the file.
