## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | For the decision the lawyer names, draft a support plan: what the decision is, whether more time is needed, whether to use shorter steps or a communication aid, and whether the client wants a support person there. It does not decide capacity, and it does not name who may conduct the claim. |
| What the lawyer must review | The lawyer decides whether support is enough for this decision, now. The plan is not a capacity finding and does not appoint anyone. Check ASCR r 9, APP 11, and whether a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Check every instance**

The lawyer and the tool work together. The lawyer checks this output before it is used.

- What the AI does: For the decision the lawyer names, draft a support plan: what the decision is, whether more time is needed, whether to use shorter steps or a communication aid, and whether the client wants a support person there. It does not decide capacity, and it does not name who may conduct the claim.
- What the lawyer does: The lawyer decides whether support is enough for this decision, now. The plan is not a capacity finding and does not appoint anyone. Check ASCR r 9, APP 11, and whether a breach is notifiable under the Privacy Act 1988 (Cth).
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. The plan is for the decision the lawyer named. It does not say the client can or cannot instruct on every decision.
2. A support person is included only if the client wants that person there.
3. If a substitute decision-maker is already appointed, stop and use the task that identifies who conducts the claim.
4. Do not ask for a medical report unless the lawyer has the client's consent.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Health and client information stays in a firm-controlled tool. A public tool is not used.
- This task is not the capacity screen and does not identify a litigation guardian or tutor.
- The Guardianship and Administration Act 2019 (Vic) was not opened. The introduction does not cite a section.
