| How AI is used | From the firm's conference checklist and the support needs the lawyer has marked, prepare a plan of who may attend, breaks, and which records to collect before any account is taken. Write none of the client's account. |
| What the lawyer must review | The lawyer takes any account. Do not let the plan become a draft the client adopts. Do not treat the guidelines as binding. They follow the Act's definition of child abuse. Check any confidentiality clause against the guideline before the client is asked to accept it. Keep the file in the firm's system. Confidentiality and APP 11 apply. |

## Checking plan

**Verify against sources**

The lawyer runs the conference. The tool writes a plan and writes no account.

- What the AI does: From the firm's conference checklist and the support needs the lawyer has marked, prepare a plan of who may attend, breaks, and which records to collect before any account is taken. Write none of the client's account.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The November 2022 guidelines are not binding. They say they apply to child abuse as they define it, following the Civil Liability Act: sexual or serious physical abuse, or connected psychological abuse.
2. They say the State should minimise re-traumatisation, train lawyers in a trauma-informed framework, consider resolving a matter without a statement of claim, and offer an apology where the State has acted improperly, ordinarily by a senior executive.
3. A confidentiality clause is considered case by case and, if used, should not stop the claimant discussing the circumstances of the claim and the claims process.
4. The State will help identify the proper defendant. The plan does not summarise the client's account.

## Notes

- The guidelines do not bind a private institution. Paragraph 16 says they do not bind the State.
- Do not create a document for the client to sign or adopt.

## Practical guide

Jurisdiction: Queensland. A first conference in the firm. The guidelines are for the State and its agencies.

**Deliverable**: A conference plan covering support, breaks and the records to collect before an account is taken.

**Inputs**

- The lawyer's support notes
- Whether the defendant is the State
- The records already held

**Example**: Illustrative example: The defendant is the State. The plan notes that the guidelines say an apology is considered where the State has acted improperly, and it lists the records to collect. It does not draft the apology or the client's account.

**Stop and escalate when**

- The plan starts to summarise the abuse.
- The guidelines are described as binding a private school.
