| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the firm's conference checklist and the support needs the lawyer has marked, prepare a plan of who may attend, breaks, and which records to collect before any account is taken. Write none of the client's account. |
| What the lawyer must review | The lawyer takes any account. Do not let the plan become a draft the client adopts. Before an account is given to a State agency, tell the client about principle 17. Record that the principles are described as binding, applied flexibly, and tied to the s 6A definition. Keep the file in the firm's system. ASCR r 9 and APP 11 apply. |

## Checking plan

**Verify against sources**

The lawyer runs the conference. The tool writes a plan and writes no account.

- What the AI does: From the firm's conference checklist and the support needs the lawyer has marked, prepare a plan of who may attend, breaks, and which records to collect before any account is taken. Write none of the client's account.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The principles apply to child abuse as defined in Limitation Act s 6A. They are described as binding, and as applied flexibly. They apply to current and future claims, not claims already judicially determined or settled.
2. They call for trauma-informed training, early acknowledgement, and access to records subject to other people's privacy and legal professional privilege.
3. Principle 14 says a confidentiality clause, if used, should not stop the claimant discussing the claim and the claims process. Principle 16 says an apology should be offered where the State has acted improperly.
4. Principle 17 says agencies acknowledge they are required to report claims of any serious indictable offence to the NSW Police Force. Tell the client that before an account is given to a State agency.

## Notes

- The principles are for State agencies. Do not present them as binding a private institution.
- If this is used in a Supreme Court document, read Practice Note SC Gen 23. The Court's page records amendments that came into effect on 3 February 2025. The note itself was not opened, so no clause is quoted.
- Records on this file stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales. A first conference in the firm. The principles are for government agencies.

**Deliverable**: A conference plan covering support, breaks, the records to collect, and the principle 17 warning where the defendant is the State.

**Inputs**

- The lawyer's support notes
- Whether the defendant is a State agency
- The records already held

**Example**: Illustrative example: The defendant is a department. The plan says the lawyer will speak with the client about principle 17 before any account is sent to the agency. The plan does not set out the account.

**Stop and escalate when**

- The plan starts to summarise the abuse.
- An account is enclosed to a State agency before principle 17 has been discussed.
