| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | In a firm-controlled tool, extract dated facts from the Victorian treatment, wage and scheme records into a fact base, each fact tied to its source page, for the lawyer to verify. |
| What the lawyer must review | Verify every extracted fact against its source page before it is used. Decide which facts matter for a transport, work or Wrongs Act claim. Keep health and wage records in a firm-controlled tool. ASCR r 9 and APP 11 apply. |

## Checking plan

**Verify against sources**

The lawyer verifies each fact and decides which Victorian scheme the fact base is for.

- What the AI does: In a firm-controlled tool, extract dated facts from the Victorian treatment, wage and scheme records into a fact base, each fact tied to its source page, for the lawyer to verify.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Extract only dated facts that appear on a source page, and keep the page reference with the fact.
2. Separate transport-accident facts, work-injury facts and public-liability facts. One incident can sit in more than one path.
3. Do not turn the fact base into a liability conclusion, a diagnosis or a damages figure.
4. If the fact base will support a court document, flag that the court's AI practice note applies before anything is filed.

## Notes

- Keep health, wage and scheme records in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
- If the product supports a court document, apply the note for that court: Supreme Court Practice Note SC GEN 25 (14 May 2026), the County Court practice note on artificial intelligence by court users (9 June 2026), or the Magistrates' Court guidelines issued 19 October 2026. One tool cannot verify another. Do not put confidential or sensitive information into a public tool.
- Medical Panels give legally binding answers to medical questions, on a workers' compensation referral or a Wrongs Act referral. The fact base does not restate a Panel opinion as the firm's own.

## Practical guide

Jurisdiction: Victoria: plaintiff personal injury, across TAC, WorkSafe and Wrongs Act matters

**Deliverable**: A source-linked fact base the lawyer has verified, ready to support a scheme claim or a later court document.

**Inputs**

- Clinical records
- Wage records
- Scheme decisions and claim forms
- Lawyer's issue list

**Example**: Illustrative example: The records contain three dates for the same shoulder injury. The tool lists each date with its page. The lawyer decides which date is the injury date for the claim.

**Stop and escalate when**

- A fact cannot be tied to a source page.
- The records would have to be placed in a public tool.

Checked 2026-10-23.
