## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the medical, payroll and correspondence records the lawyer supplies, extract dated facts into one table: event, symptoms, treatment, time off work, and notices already given. Each row cites the document. Do not fill gaps with an inference, and do not write a notice or a court document. |
| What the lawyer must review | Verify each fact against the source page before it is used. Decide which scheme the facts belong to before any notice is prepared. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The fact base is an internal table. The lawyer verifies every row against the record.

- What the AI does: From the medical, payroll and correspondence records the lawyer supplies, extract dated facts into one table: event, symptoms, treatment, time off work, and notices already given. Each row cites the document. Do not fill gaps with an inference, and do not write a notice or a court document.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Keep only facts that appear in a document on the file.
2. Separate incident date, first symptoms, first treatment and first lawyer instruction.
3. Flag missing payroll for the 12 months before a work injury.
4. Do not turn the table into a notice, a statement or a submission.

## Notes

- Health, wage and benefit records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- A PIPA notice must be accompanied by the documents a regulation requires, and it authorises access to records. The fact base is not that notice.
- If the product is used in a Supreme Court submission, Practice Direction 5 of 2025 requires the named practitioner to verify every reference. District Court Practice Direction 12 of 2025 is the matching direction opened for that court.

## Practical guide

Jurisdiction: Queensland plaintiff personal injury file, before a notice or a proceeding

**Deliverable**: A dated fact table with a document cite on every row.

**Inputs**

- Medical records
- Payroll or payslips
- Correspondence and any notice already sent
- The scheme the lawyer has named, if any

**Example**: Illustrative example: Three discharge summaries use two different injury dates. The table keeps both, each with its document, and leaves the controlling date blank.

**Stop and escalate when**

- A row has no document cite.
- The output is being prepared as a document to file.
