## Key facts

| Fact | Value |

| How AI is used | From the incident report, photographs and any lease or title the lawyer marks, list each person or body who occupied or controlled the place, with the document that shows it. Do not choose the defendant. |
| What the lawyer must review | The lawyer decides who occupied or controlled the place, and which duty section applies. Do not name a defendant from a sign or a website alone. Match the name to a document. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Source-by-source verification**

Trace relied-on content to independent sources and check for relevant material the output has missed.

- What the AI does: From the incident report, photographs and any lease or title the lawyer marks, list each person or body who occupied or controlled the place, with the document that shows it. Do not choose the defendant.
- What the lawyer does: The lawyer decides who occupied or controlled the place, and which duty section applies. Do not name a defendant from a sign or a website alone. Match the name to a document. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth).
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Match each named occupier or controller to a lease, title, incident report or photograph, not to a sign alone.
2. In Victoria apply the section 14B factors. Do not replace them with the New South Wales or Queensland breach section.
3. In New South Wales and Queensland record the section 5B or section 9 question, and do not invent an occupier's part.
4. Leave the choice of defendant blank for the lawyer.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
