| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the offer or acceptance the lawyer provides, list the institutions named. Keep a Forde Inquiry release on a separate row from a National Redress Scheme acceptance. Do not advise whether to accept. |
| What the lawyer must review | Decide which civil claims survive under the Commonwealth section 43 release. Do not treat the Forde guideline as undoing a National Redress Scheme acceptance. Do not treat the guideline as binding the State. It is about a different scheme. Keep the file in the firm's system. Confidentiality and APP 11 apply. |

## Checking plan

**Verify against sources**

The lawyer decides what the acceptance releases. The Forde guideline is a separate Queensland document.

- What the AI does: From the offer or acceptance the lawyer provides, list the institutions named. Keep a Forde Inquiry release on a separate row from a National Redress Scheme acceptance. Do not advise whether to accept.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The release is Commonwealth s 43. It releases a released institution or official for abuse within the scheme. It does not release another institution or person. The abuser is not a released official.
2. The November 2022 guidelines say the State should ordinarily not rely on a release given under the Forde Inquiry redress scheme, though the payment may be taken into account. That guideline is about the Forde scheme.
3. The guidelines do not bind the State. They do not say that a National Redress Scheme acceptance can be reopened.

## Notes

- Do not move a Forde payment onto the National Redress Scheme row, or the reverse, unless the document says which scheme it is.
- Guide 4.8, version 1.31, was released on 21 September 2026. Section 4.8 was last reviewed on 20 March 2025.

## Practical guide

Jurisdiction: Queensland, for the civil claim that remains. The National Redress Scheme release is in the Commonwealth Act.

**Deliverable**: A release map that keeps a Forde deed and a National Redress Scheme acceptance on separate rows.

**Inputs**

- The offer or acceptance
- Any Forde deed
- The institutions named

**Example**: Illustrative example: The file has a Forde deed and a later National Redress Scheme offer. The tool puts them on two rows. The lawyer decides what each document releases. The tool does not say the guideline undoes the scheme acceptance.

**Stop and escalate when**

- The tool is asked to advise acceptance or refusal.
- The two schemes have been collapsed into one row.

Checked 2026-10-23.
