| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | In the firm-controlled tool, from the placement contract, the injury facts and the defendants the lawyer names, make a table of the employer claim and any host or other non-employer claim, with the pre-court steps the opened provisions attach to each. Do not decide who owed the duty. |
| What the lawyer must review | Decide who the employer is, and which statute governs the claim against the host. Do not treat a host as outside the employer's damages provisions until that decision is made. Keep medical and wage records in the firm-controlled tool only. Check ASCR r 9, APP 11, and whether a Privacy Act breach is notifiable. |

## Checking plan

**Source-by-source verification**

Identify the employer from the contract and the wages records before naming the host.

- What the AI does: In the firm-controlled tool, from the placement contract, the injury facts and the defendants the lawyer names, make a table of the employer claim and any host or other non-employer claim, with the pre-court steps the opened provisions attach to each. Do not decide who owed the duty.
- What the lawyer does: Decide who the employer is, and which statute governs the claim against the host. Do not treat a host as outside the employer's damages provisions until that decision is made. Keep medical and wage records in the firm-controlled tool only. Check ASCR r 9, APP 11, and whether a Privacy Act breach is notifiable.
- Who reviews: Lawyer competent in personal injury
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Identify the employer from the contract and the wages records before naming the host.
2. In Queensland, apply chapter 5 to the employer claim and section 6(2)(c) of the Personal Injuries Proceedings Act to a claim against someone who is not the employer.
3. Serve every person against whom a cause of action is claimed with the Victorian application.
4. Do not assume a host can be compelled to a New South Wales mediation.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- A claim against a host is not a second copy of the employer claim. The pre-court steps can differ.
- Medical and wage records stay in the firm-controlled tool. Check ASCR r 9, APP 11, and whether a breach is notifiable under the Privacy Act 1988 (Cth).
