| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the diagnosis and the number of defendants, mark the asbestos claims process or the Monday Directions List at 10am within six weeks of filing. Do not copy a day from the asbestos timetable. That document was not opened. |
| What the lawyer must review | Treat malignant as mesothelioma or carcinoma only. Do not use that label for another disease. Send a silica claim to the Monday Directions List. The Silicosis List ended on 3 February 2025. Do not copy a timetable day. The timetable document was not opened. Do not force a non-asbestos claim into the asbestos process. |

## Checking plan

**Verify against sources**

Asbestos damages claims follow the claims resolution process. Silica claims, since 3 February 2025, are listed in the Monday Directions List.

- What the AI does: From the diagnosis and the number of defendants, mark the asbestos claims process or the Monday Directions List at 10am within six weeks of filing. Do not copy a day from the asbestos timetable. That document was not opened.
- What the lawyer does: The lawyer chooses the process from the diagnosis and does not import a day count that was not opened.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The Tribunal page says the Dust Diseases Tribunal Regulation 2019 applies the asbestos claims resolution process to all asbestos-related damages claims.
2. Mesothelioma or carcinoma is malignant and follows a shortened timetable. Another asbestos disease is non-malignant and follows its own timetable. More than one defendant varies it.
3. Advice to Practitioners No. 3 of 2024: the Silicosis List is abandoned from 3 February 2025. A silicosis or other silica claim is listed in the Monday Directions List at 10am within six weeks of filing.
4. Section 11 says the damages proceeding may not be brought in another court. Section 11(1A) allows a contribution claim in the Tribunal, and the note says that does not prevent those proceedings in another court.

## Notes

- The Dust Diseases Tribunal practice-notes index opened on 23 October 2026 has no generative AI note. Do not treat a Supreme Court note as the Tribunal rule. Do not enter confidential information into a public tool.
- A gravely ill plaintiff can apply by notice of motion, supported by an affidavit and medical evidence, to leave the usual process. The tool does not write that application.

## Practical guide

Jurisdiction: Dust Diseases Tribunal claims resolution process, and the Monday Directions List for silica

**Deliverable**: A process map for an asbestos claim or a silica claim, with no day counts.

**Inputs**

- Diagnosis
- Number of defendants
- Whether the plaintiff is gravely ill

**Example**: Illustrative example: The diagnosis is silicosis and the claim was filed after 3 February 2025. The tool marks the Monday Directions List at 10am within six weeks, and does not mark a silicosis list. The lawyer does not ask for that list.

**Stop and escalate when**

- A day count is inserted.
- A silica claim is placed in the asbestos malignant timetable.
